These general terms and conditions apply to the online sale of our products via the website itemz.be offered in Belgium. By placing the order you accept the applicability of these general terms and conditions.

These General Terms and Conditions of Sale may be modified periodically. The version published on our website at the time of placing the order is applicable.

The data from our computer system provides full proof of the purchase transaction.

2.PRICES, OFFERS AND PROMOTIONS

Our offers and prices are only valid for purchases via the website itemz.beThe offers via the website itemz.be cannot be combined with other promotions, offers or discount coupons.

3.ORDER

After you have made your choice on the website, you can proceed to place the order by clicking on "In my shopping cart" which will place your item in your shopping cart.

From the shopping cart you can continue shopping, remove an item placed in the shopping cart or checkout.

In your shopping cart you will immediately see the prices of the selected products, the discounts, the delivery time, and the total price of the order. The total price includes VAT and all costs.

If you are happy with your choices and want to complete the order, click on 'Place order and checkout'.

To do this, you must first fill in the necessary information to ensure that the order process runs smoothly.

The order is only final after payment has been made.

Every final order will receive an order confirmation from us by e-mail, in the language of the website, stating the delivery time and stating the possibility to cancel the order free of charge if this period is exceeded. This way you know that we have received your order.

If you request it and provide your company details, we will send you an invoice by email free of charge.

4.PAYMENT

5. COLLECTION

You choose to pick up during the order. Products can only be picked up at ITEMZ at Europark 1007 in Houthalen-Helchteren.

We will contact you by phone to arrange a date when you can collect items from our warehouse.

6. AVAILABILITY

The availability is indicated for each product. We do everything we can to communicate this information correctly, but it may happen that there is an impossibility to deliver, e.g. due to errors in the stock data. In this case, we will notify you as soon as possible and refund the purchase price to you.

7. RIGHT OF WITHDRAWAL

If you are not satisfied with your purchase, you can cancel it at the time you pick it up. You will then receive the value of your purchase back.

From the day following collection, you also have 14 calendar days to cancel the purchase of any item you do not like, without having to give a reason. The right of withdrawal only applies if you are a private individual, and therefore not if you are a company, or if you have purchased the items for professional use.

How do you exercise your right of withdrawal? You must inform us by means of an unambiguous statement.

You must also return the items to us at your own expense as soon as possible, and no later than 30 days after you have communicated your decision to cancel to us.

If an item is found to be damaged, soiled or incomplete when returned, ITEMZ cannot refund this item.

The refund will be made within a maximum period of 14 days from the date that ITEMZ has received the revoked items back.

8.WARRANTY

Although our items are often in good condition, they are always offered in used condition. In view of this used condition and the older age of the items, we do not give any warranty on our items.

To preserve the charm of our vintage and industrial items, we like to sell our items in their original condition as much as possible. This may mean that there are traces of use over the years, something that you as a true vintage enthusiast can of course appreciate.

Larger, clearly visible signs of use are of course shown and/or mentioned in the photos.

9. FORCE MAJEURE

We are not liable if the non-performance or late performance of an obligation is the result of force majeure.

Force majeure means anything, foreseen or unforeseen, that makes it reasonably impossible for us to perform our obligations and that cannot be attributed to us, such as (but not limited to) war, riot, strike, pandemic, epidemic, illness, quarantine measures, fire, government measures, storm, explosions, natural disasters, earthquakes, hacking and cyber attacks.

During the force majeure period, our delivery and other obligations will be suspended. If the period lasts longer than 8 weeks, both parties are entitled to terminate the agreement, without any obligation to pay damages in that case.

We respect and protect your privacy. We value the trust you place in us, and any personal information you provide us with will be treated with the utmost care and confidentiality.

11. COMPLAINTS

If you are not satisfied, you can file a complaint by sending an email to info@itemz.beYou will be informed within 5 working days after sending it about the period within which your complaint will be handled.

13. APPLICABLE LAW AND JURISDICTION

The judicial settlement of disputes will be exclusively in accordance with internal Belgian law.
